Terms of Service

1. Overview and Expedition Readiness

This website, operated by WildPackGear (“we,” “us,” or “our”), provides e-commerce services for premium camping equipment and outdoor gear. By accessing this site or purchasing any products, you agree to be bound by these Terms of Service (“Terms”), including all policies incorporated by reference. These Terms apply to all users, including browsers, customers, and contributors.

These Terms are structured around your expedition readiness—from product information and pre-purchase checks, through dynamic wallet payment and order acceptance, to delivery, field use, and dispute resolution. Nothing in these Terms limits any mandatory rights available to you under applicable consumer law.

2. Eligibility and Age Restriction

By agreeing to these Terms, you represent and warrant that you are at least 18 years of age (the age of majority in your jurisdiction). If you are under 18, you may use our services only with the involvement and consent of a parent or legal guardian. You may not use our services for any unlawful purpose, nor violate any laws in your jurisdiction (including but not limited to copyright and trademark laws). You shall not transmit any worms, viruses, or code of a destructive nature. Any breach of these provisions may result in immediate termination of your access.

3. General Conditions

We reserve the right to refuse service to any person for any reason at any time, subject to applicable law and our obligations regarding orders already accepted. You understand that your content (excluding payment data) may be transferred unencrypted over various networks and may be adapted to conform to technical requirements. Payment data is always encrypted during transmission through our systems or handled by our payment service providers. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of our services without express written permission from us.

4. Product Information, Pricing, and Service Modifications

4.1 Current Product Information Status

Some product pages on the Site may currently display product images and limited descriptions, and may not include complete specifications such as material composition, dimensions, capacity, weight, insulation ratings, care instructions, or intended use. We are working to improve product information coverage, but we do not represent that every product page contains a complete specification table.

Product images are provided for visual reference. Colours, textures, and proportions may appear differently depending on your monitor or device settings. Images alone should not be treated as a complete description of material, size, capacity, weight, or suitability for a particular environment.

4.2 Pre-Purchase Specification Requests

If a specification that is important to your purchase decision is not displayed on the product page—such as fabric composition, insulation type (e.g., down vs. synthetic fill), hardware materials, dimensions, weight, or temperature ratings—please contact us at [email protected] before placing your order.

We will provide the information available to us or confirm if it is unavailable. If we cannot confirm a specification that is critical to your intended use, you may choose not to purchase the product. You are responsible for telling us about any specific requirement that is critical to your purchase so that we can confirm whether the product meets it.

You are not responsible for verifying specifications that we did not disclose and that were not made available to you before purchase. We are responsible for the accuracy of the product information we provide. We do not exclude or limit liability for misdescription, for products that are not as described, or for products that are unsafe or not fit for their intended purpose, to the extent required by applicable consumer law.

4.3 Prices and Availability

Prices for our camping equipment are displayed at checkout in the currency shown and are subject to change without prior notice. However, price changes will not affect orders that we have already accepted, except where an order is cancelled due to a manifest pricing or product-information error.

If we identify a manifest error in price or product information before dispatch, we may cancel the affected order and issue a full refund to the original payment method. We will make reasonable efforts to notify you before or promptly after cancellation. We will not charge a cancellation fee in these circumstances. Certain items may be available in limited quantities and are subject to return or exchange only in accordance with our Returns & Refunds Policy. We reserve the right to limit the sales of our products to any geographic region, jurisdiction, or individual.

5. Billing, Dynamic Wallet Payment, and Order Acceptance

5.1 Dynamic Wallet Routing and Order Placement

We currently accept iDEAL, Bancontact, and BLIK for camping equipment purchases. Payment method availability is destination-dependent and order-dependent.

Our checkout process operates as follows:

  1. You add items to your cart, proceed to checkout, and fill in your required billing and shipping information.
  2. You click “Place Order”.
  3. Only after clicking “Place Order” will our system evaluate your shipping destination, order currency, and order value, and dynamically load the available wallet payment options. You will not see the final list of available wallets during the initial information-filling stage.
  4. You select your preferred wallet payment method from the options displayed.
  5. You are handed off to the selected payment provider’s secure interface to authorize the transaction.

Clicking “Place Order” generates an order record in our system with a status indicating that payment is pending or incomplete. An order is not complete, nor is it accepted for processing or dispatch, until the wallet payment has been successfully authorized and verified.

5.2 Wallet Authorization and Account Accuracy

Depending on the method and your location, authorization may involve your banking application, your payment provider’s app, a QR code, a one-time code, biometric verification, or other verification steps required by the provider.

We do not ask you to enter credit or debit card details on our Site for these wallet payment methods. We do not request or store your online banking password, wallet login credentials, full payment account number, CVV, or one-time authentication codes. Our customer service team does not need these details to assist with a billing or payment inquiry.

You agree to provide current, complete, and accurate purchase and account information for all transactions. You are responsible for promptly updating your account details, including email address, shipping address, and selected wallet payment method, so that we can successfully process your transactions and contact you.

5.3 Fraud Prevention and Order Limits

We reserve the right to refuse or cancel any order you place with us, subject to applicable law. In the event that we make a change to or cancel an order, we will attempt to notify you using the contact information provided at the time the order was placed. We may place limits on orders placed by the same household, payment method or limited payment identifier where available, or account. We actively monitor for fraudulent activities. Any suspected fraud, unauthorized use of payment methods, or violation of these Terms will result in order cancellation and may be reported to the relevant authorities.

6. Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the Site or its content:

(a) for any unlawful purpose;
(b) to solicit others to perform or participate in unlawful acts;
(c) to infringe upon intellectual property rights;
(d) to harass, abuse, insult, harm, or discriminate against any person;
(e) to submit false or misleading information;
(f) to upload or transmit viruses or any other malicious code;
(g) to collect or track the personal information of others;
(h) to spam, phish, or engage in any similar deceptive activity;
(i) to resell, redistribute, or drop-ship our products without express written authorization; or
(j) to interfere with or circumvent the security features of the Site.

We reserve the right to terminate your use of the Site for violating any of these prohibited uses.

7. Intellectual Property

All content included on the Site, such as text, graphics, logos, images, product descriptions, and software, is the property of WildPackGear or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, distribute, or display any of our intellectual property without our prior written consent. The WildPackGear name and logo are trademarks of WildPackGear.

8. User Submissions

If you submit comments, suggestions, ideas, or other materials (collectively, “Submissions”), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any Submissions that you forward to us. We are under no obligation to maintain the confidentiality of any Submission, to pay compensation for any Submission, or to respond to any Submission. You agree that your Submissions shall not violate the rights of any third party, nor contain unlawful, abusive, or obscene material, nor contain any computer malware.

9. Third-Party Tools and Links

We may provide you with access to third-party tools over which we neither monitor nor exercise any control. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, to the extent permitted by law. Our Site may contain links to third-party websites or services that are not owned or controlled by us. We assume no responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge that we shall not be liable for any damage or loss caused by your use of such third-party offerings.

10. Consumer Rights and Mandatory Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, right, or remedy that you have under applicable consumer law and that cannot lawfully be excluded, restricted, or modified.

Where you deal with us as a consumer, you may have statutory rights relating to conformity, fitness for purpose, description, withdrawal or cancellation, and remedies for defective products. These Terms are subject to those rights. If any provision of these Terms conflicts with a mandatory consumer right, the mandatory right will prevail to the extent of the conflict.

11. Outdoor Use, Safety, and Allergen Disclosure

Camping and outdoor activities involve inherent risks. You acknowledge that you are responsible for using any product purchased from us in a reasonable and proper manner, following any care, loading, setup, and safety instructions provided. Where no instructions are provided, you should use the product in the manner reasonably expected for its type and intended use.

If you have a known sensitivity or allergy to a particular material (such as down, synthetic fill, dyes, metals, or coatings), and material information is not displayed on the product page, please contact us before purchase so that we can provide the available information. If we cannot confirm the material information you need, you may choose not to purchase the product.

We are not liable for allergic reactions, injuries, or damages resulting from improper use, overloading, normal wear and tear, or reactions to materials where the relevant materials were accurately disclosed and the product was used as intended. This limitation does not apply where materials were not disclosed, were misdescribed, or where the product was unsafe or not as described. Where material information was not displayed and you did not receive it despite asking us, we will assess the matter under applicable consumer law and our Returns & Refunds Policy.

12. Disclaimer of Warranties

We do not guarantee, represent, or warrant that your use of our services will be uninterrupted, timely, secure, or error-free. The services and all products delivered to you are provided “as is” and “as available,” except as expressly required by applicable law or mandatory consumer rights.

To the fullest extent permitted by law, we disclaim all implied warranties, representations, and conditions of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. This disclaimer does not exclude any warranty, guarantee, or condition that cannot lawfully be excluded, including those relating to conformity, description, or fitness for purpose under applicable consumer law.

13. Limitation of Liability

To the fullest extent permitted by law, and subject to Section 10 (Consumer Rights and Mandatory Law), WildPackGear, our directors, officers, employees, affiliates, agents, contractors, or suppliers shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the services or any products procured using the services, even if advised of the possibility of such damages.

To the fullest extent permitted by law, and subject to Section 10, our total aggregate liability arising out of or relating to a product or order shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability for:

(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) intentional misconduct or gross negligence;
(d) breach of any statutory consumer guarantee or mandatory right that cannot be excluded;
(e) any other liability that cannot be excluded or limited under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless WildPackGear and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party, except to the extent the claim arises from our own negligence, fraud, misrepresentation, or breach of these Terms or applicable law.

15. Privacy Policy

Your submission of personal information through the Site is governed by our Privacy Policy, which is incorporated herein by reference. Our Privacy Policy explains how we handle wallet payment data and the sensitive payment credentials we do not collect.

16. Errors, Inaccuracies, and Omissions

We endeavour to provide accurate product descriptions, pricing, and promotional information; however, errors may occur. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice. However, where an error relates to an order we have already accepted, we will handle the matter in accordance with Section 4 (Product Information, Pricing, and Service Modifications) and applicable consumer law. We undertake no obligation to update, amend, or clarify information on the Site except as required by law or to correct an error affecting an accepted order.

17. Termination

These Terms are effective unless and until terminated by either party. You may terminate these Terms at any time by notifying us that you no longer wish to use our services, or when you cease using our Site. If, in our sole judgment, you fail to comply with any term or provision of these Terms, we may terminate this agreement at any time. All obligations incurred prior to termination shall survive, including payment obligations, return obligations, and provisions concerning intellectual property, liability, and governing law.

18. Severability and Entire Agreement

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of any remaining provisions. These Terms, together with any policies or operating rules posted by us on the Site, constitute the entire agreement between you and us, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

19. Changes to Terms

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates on the Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes. Changes will not retroactively affect orders already accepted, except where required by law or to correct a manifest error in accordance with Section 4.

20. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Mississippi, United States of America, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Mississippi, subject to any mandatory right you may have under applicable consumer law to bring proceedings in your place of residence.
